Terms of Service

1. Agreement

These Terms of Service ("Terms") govern access to and use of the Phase Systems platform at https://app.phaseconnect.co.uk (the "Service"), operated by Phase Systems. By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Phase Systems provides digital business cards, team workspaces, lead capture forms, and engagement analytics. Features may change as we improve the product. We aim for high availability but do not guarantee uninterrupted access.

3. Accounts & security

• You must provide accurate registration information and keep credentials confidential.
• You are responsible for activity under your account and for configuring team roles appropriately.
• Notify us promptly at team@phasesystems.co.uk if you suspect unauthorized access.

4. Your content

You retain ownership of content you upload or publish through the Service (profile details, images, links, lead form configuration, etc.). You grant us a limited license to host, process, and display that content solely to operate the Service — including serving public card pages, delivering leads to your inbox, and generating analytics.

You must have the rights to all content you publish and must not upload unlawful, misleading, or infringing material.

5. Acceptable use

You agree not to:

• Use the Service for spam, harassment, fraud, or illegal activity.
• Attempt to breach security, scrape the platform abusively, or interfere with other users.
• Reverse engineer the Service except where permitted by law.
• Misrepresent your identity or affiliation on public card profiles.

6. Plans, billing & trials

Paid plans are billed through Stripe. Prices and limits are shown at checkout and in-product. Subscriptions renew until cancelled in accordance with Stripe and your plan settings. Taxes may apply. Refunds are handled per our published billing policy and applicable law.

7. Privacy

Our collection and use of personal data is described in the Privacy Policy. Lead and analytics data you collect through your cards remain under your control as the account holder, subject to your own legal obligations to visitors.

8. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that public card pages will meet your regulatory requirements without your own review.

9. Limitation of liability

To the maximum extent permitted by law, Phase Systems and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability for claims relating to the Service is limited to the greater of amounts you paid us in the twelve (12) months before the claim or one hundred pounds sterling (£100).

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access for material breach of these Terms or to protect the Service and other users. Upon termination, your right to use the Service ends; we may retain data as described in our Privacy Policy.

11. Changes

We may update these Terms. We will post the revised version on this page with an updated date. Continued use after changes become effective constitutes acceptance. For material changes, we may provide additional notice in-product or by email.

12. Governing law & contact

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Courts in England and Wales have exclusive jurisdiction, subject to mandatory consumer protections where applicable.
